Sadhvi Pragya [Images] Singh Thakur has decided to move the Bombay High Court challenging the provisions of the Maharashtra Control of Organised Crimes Act which has been slapped against her in connection with the Malegaon blast case.

Counsel for the Sadhvi Pragya, Ganesh [Images] Sovani told rediff.com that he would move the high court on behalf of his client within a week. Sovani said that the application seeking to discharge her from the case would be filed on the grounds that there is no tangible evidence to prove her role in the crime. There is no evidence to show that the motorcycle used in the blast was under her control and there is also no evidence on record to substantiate the case against her, Sovani said.

Sovani said that he has not yet received a certified copy of the order which confirmed the charges under MCOCA against his client. "Once we get the certified copy, we will prepare the application and move the high court seeking discharge," he said.

Sovani said that the Sadhvi maintains that she is innocent and is hopeful of coming out clean in the case. The Mumbai [Images] Anti-Terrorism Squad has slapped charges under Sections 302, 306, 326, 324, 120 (b) and 153 (A) against the Sadhvi.

Sovani also said that the bail plea of all the accused in the Malegaon case will come up for hearing on Friday.
